These ppl are talking about giving amnesty to ILLEGALS...let me repeat it.. amnesty=award for being ILLEGAL. They have done that before and all of a sudden we F'KIN LEGAL TEMP WORKERS from India/China have to worry about the LEGAL aspect of filing a law-suit.

I think most important things you need to consider: (Considering the fact that PD will be pushed back to stone ages in September Bulletin)
a) Hope that your I-485 Application is not approved before your PD becomes current. If this happens, it's a royal screw up until your wife keep's her own status (F1, H1).
b) Earlier, it was predicatable when your PD would become current and it allowed most of the folks to add their spouses at later time.
c) Bigger question is whether they would process on the basis of PD or RD. I think it's unfair to do it on basis of RD as most of the people would be jumping lines. Currently it's done on the basis of RD, but USCIS might change their SOP because of this July VB Fiasco.
d) As others suggested, make sure to maintain your H1B status as long as possible without invoking your EAD. This way, you can continue to keep your wife on H4 status (Unless she can keep her own status for atleast another 2-3 years).
I am in the same boat with EB-2 PD of Aug 2005. My spouse is outside US to get her F1-H1B stamping as her OPT Expired few weeks back.

although i strongly refute the possibility that hiring managers are eating money
Trust me my friend, I have seen it happen all the time, from large Telecom firm to Govt., its always there, most of the consultants just doesn't come to know about it, but the cut for the managers is there in some form, almost always. Why do each manager has a specific vendor through whom they want to hire most of the time? What else is the reason for the client to pay the consulting company $180/hr but they won't give 'valueablehurdle' anything more than $50-60/hr?
On a different note, now that NSG approved the waiver, most desi uncles, some of them are also owners of desi consulting companies will claim that they are the father of Nuclear deal. These bastards (sorry for my french) always oppose any GC fix and they tell their favorite congressman/senator (each has atleast one favorite politician for whom they do fund raisers) that gc backlog is not an important issue for the community. India Abroad, Times of India, rediff and other desi portals/newspapers will write 'Oliver North' style stories about these desi uncles knowing well that companies like GE etc put their weight behind the deal as it will create commerce to commerce over $20 billion/yr. But desi uncles/orgs will not stop claiming to be the father of nuclear deal. The fact is, most of these desi uncles made noise not because they wanted to do something for their country of birth, they are doing it because they think that if the nuclear deal passes, they can play middle man for US companies to sell the technology/material to Indian companies/govt. Most of the so called 'united voice of Indian-Americans on the Hill' organization's goal is to make big bucks by playing 'middle man' for companies wanting to sell technology to India. And as always, just as 'valuablehurdle''s client (paying $180/hr) Indian govt. will pay double the cost. These desi companies have squeezed blood of people waiting for gc, but now they think its time to move on to play big game with the big boys. These desi uncles/orgs are going nuclear.... time for Rediff and India Abroad to play Oliver North. Sometimes the line between capitalism and cycle of corruption is extremely blur. The problem is, these desi uncles/orgs claim to be representatives of entire Indian-American community, sometimes the entire immigrant community. It DOES matter what your PD is. USCIS apparently does process FIFO according to your Receipt date - BUT ONLY IF YOUR PRIORITY DATE IS CURRENT will you get a visa number assigned (i.e. approval of said greencard).
From my understanding, this is correct but if you look at , http://www..com/usa-immigration-trackers/i485-tracker1/ USCIS is approving applications everyday. I am confused because according to the August visa bulletin, all categories are "unavailable" therefore, we shouldn't be seeing any approvals. Please enlighten me on this.

Hello all,
Here is my status
I am currently using H1(3 year extension since I140 was filed) and wife is using EAD. And I also have EAD and approved I140. I have filed for my I-485 (2005 PD) with my current company in Midwest in July 2007.
I have an offer from a company in California. Is it OK to accept the offer.
1. Does it matter if I change the geographical region
2. Also my field of work does not change. Only thing that might change is my increased roles and responsibilities and my designation for example from Senior Staff Engineer(Company X) to Principal Staff Engineer (company Y)
I would like to know if Would be in trouble or if my GC would be in trouble having waited from 1997(F1) until now.

I say my chance is 88.25% of getting approved :). Don't ask me how I got this number. All that I know is optimism is free
I checked with some folks who have got GCs in the past and they mentioned that FP (2nd time ) is not needed.....unlike the minds of USCIS one's FP doesn't change over his lifetime...that said..if you apply renew EAD u can get FP notice....
But if 15 month rule of FP is correct then very few will get approved as very few have received 2nd FP notice....so I am not sure what is good or bad...we need to know if the folks who had got FP notice had recently renewed their EADs or not.
I am current next month but I rate my odds as 2/98 meaning 2% chance of getting clear.....taking into account RD/ND/transfer/FP all vagaries into account....even Indian monsoon is more predictable.

There are favorable indications from the industry that they will get increased H1Bs. There is hence a strong belief among many lawyers that the H1B lobby will provide some relief. But we need to meet lawmakers so that they don't forget about the Green cards.
If you live in NY state, please contact bottlemani or myself. We need to organize ourselves before meeting the lawmakers. We will also have to take the trouble to drive to their offices. If we don't do this, all these pessimistic predictions will come true. Believe me, meeting the folks in the offices of the lawmakers makes a huge difference.

It is sad to see that only few people have signed up for state chapters. there are very few on your NY thread even though we have several members from NYC and NY state. We all need to change our attitude and help each other in this common cause. If we all think that someone/others will do it for us, then nobody will do anything and we will all continue to wait for our greencards for the next several years. IV is providing everyone an opportuity and tools to help and work. IV core is working overtime to get it done. We cannot succeed if we do not get support from each and every member.

This is not to put you down but to help you. How long have you been in the US? If more than 1 year, I would suggest taking a course to improve your written and spoken English. It is way too bad. :o and will help you in the long run in case your Eb3 gets approved and you stay as PR in the USA.
2 year back my I-140 got rejected due to same reason 3+2 degree. I have 3 years Bsc in Computer science and 2 years Master of Computer Mgmt. They raise the question on 3 year Bachealor dagree. My lawyer send the reply along with degree evaluation and we try to say my 3+2 equal to 4+2 of USA and USCIS didn't buy this argument. after that lawyer told me that no hope in MTR or appeal. So we file again in Eb3.
Now i see based on your reply if have taken this approach in appeal then i might have got approval in appeal.

also this bill is for Skilled legal immigrants only and has nothing to do with the illegal immigrants.
One benefit of passing this bill will also boost the economy as skilled legal immigrants will be in the market to buy new homes (clrealry mentioned in the statement of Greenspan).
last time is sent this letter to senator in Ga, he replied back in regards to increasing the number of H1B..Yeah he replied for h1B and he wrote a long email. this time i am going to clear his confusion..

I am as well in the similar situation as you are in. I am looking to do MS from Aspen University. Its is full online program and it costs approximately $4000 to complete masters program. I have been trying to know more about that university and until now I did not hear anything bad about the university except that the univerisity is Nationally accredited university. I am trying to know whether USCIS accepts Masters from Aspen University. Please let me know if you have got any information regarding this.

if its BS+2 yrs..u shud be producing Exp letters for 2 years...

Only Eb2+ 5 years of progressive work experience requires all the employment letters throughtout the 5 years. Am I accurate?
