I agree with most. We should not expect major "Forward" movement in dates until the 3rd & the 4th quarter of USCIS' fiscal year! Until then we might as well keep the prediction threads to the minimum.

I respectfully disagree, he is the president of USA and to its citizens, you might morally/personally declare him to be your president, but as long as your passport is not from USA you my friend are an alien (not extraterrestrial) living in the US of A :), please dont take this personally I am in the US too, and I got my passport recently renewed, and I had to pledge my allegiance in order to get my passport. It's just a law point. And I wish you all the best in your endeavor. Bharat mata ki Jai.
Dear Friend, I am totally correct to congratulate and call Mr. Obama as our President. He is definitely our President, since we live in US soil. As I aspire to become a US citizen ( I know a long way ahead) I should love US more than any other country in the world.
I dont believe in staying at one place and think of another place. US is very special in my heart that is why I want to become an US citizen eventually. I want to blend in the melting pot of US.
I hope most of us immigrants feel the same way for the country we want to permanently live in. We did not select our country of birth but we have selceted US as our country to live in. So I feel I should love US more as I have selected this country as my country to be.

Question gurus... I have a xerox copy of my approved I-140. Will this be enough to port the priority date? or do you need the original copy to be submitted along with the new I-140 application when you request portability of older priority date?? please clarify.

In my humble opinion, if people who have been illegal in US for over 5 years are granted legality, then the govt should
1) Close the backlog processing centers where our cases have been languishing for years
2) Grant us green cards if we can show minimal proof that we did infact file for permanancy legally at some point in time.
I mean COME ON guys..the government is giving legal status to more than 10 MILLION illegals in this country, yet when it comes to 300,000 tax paying, qualified, LEGAL, degree holding H1B workers, the same government is penny pinching and trapping us in a bureaucratic paper nightmare. What is 300,000 when compared to like 13 Million?? Its a drop in the bucket. Do not forget that our employers have paid big bucks for every H1B, and additionally paid for the creation of the backlog reduction center, where they are painstakingly poring over each and every case with a toothcomb.

I would not worry much about whether we receive our package back or not. Because If USCIS is "rejecting" then how would you/your lawyer know that it has "rejected" it unless it sends the crap back. So legally USCIS HAS to return /mail back to you otherwise it will face another lawsuite. The real question is How it will reject it? Would it open a package and check for insufficient/improper documents and put a note about it and then reject it OR just put a note of rejection on closed envelope and returned back without opening it? In second case we are absolutely fine as far as second time filing is concerned but guys in first scenario if you really send insufficient documents/improper documents then your case may be screwed permanently for second time filing. Actually people MUST ask about this to their lawyers before jumping into the bandwagon. I have asked and waiting for my lawyer's response.

And you think this is the way for convincing law makers on our contributions to American society? Is it because of your bad language, the law makers should give your spouse, EAD?

I can say that I have traveled on several occasions out of the United States to Canada, Mexico and the UK for business and pleasure using Advance Parole without incident. I don't understand how Customs and Border Protection can expect us to remain in the United States indefinitely and postpone living our lives! I am fully aware of the statute but I don't buy into its literal interpretation. This is just an opinion. Ultimately you must decide individually what you feel comfortable doing.

How about if I send in Ac 21 paperwork and still be on leave of absence from my present company which sponsored my GC. It only gives me peace of mind because in case the new job does not work out I can still come back...
If you will be using EAD for new job, stop worrying about vacation. EAD is a "AOS" state meaning you are legally allowed not to even work so you can very well take vacation and even decide not to work till you get the green card. If you are playing "h1 transfer" then your vacation may become tricky if you do not get salary for that vacation. It may have an advese effect down the road. If I would be you and have decided to use H1 transfer then I would not go to unpaid vacation. If you will be paid for the vacation you will be fine for that too.
