Hi,
I had sent an e-mail to my attorney...below is his reply...looks like i will get my renewed EAD before current EAD expires.
USCIS typically issues new EADs within 90 days. If they don't, you may make an Infopass appointment to appear in-person at a local office to request that they process an interim EAD. The local office will not issue an EAD. Rather, they will contact the Service Center which will typically issue the EAD within two weeks.
Not sure if this rule still valid (some websites still has them , including murthy),

Just to follow up on BKarnik's response. Eventually, all DMV will be on the same page. As I'v mentioned earlier, some dmv branch office here in colorado have no clue why the computer system was referring my friend to MVI and after my friend went to another branch, that's were they found out that this new procedure was implemented just in August 2006.
If it has not happened in some other states, that's good and I hope this procedure will succeed.
Remember, this has no exception even for citizens.

I am thinking of buying a home without waiting for GC approval. I am EB3 I with PD 2006. No hopes of GC in near future. Just want to see the trend....

It is a personal choice plus the level of risk you take, I bought my house before my GC was approved and here I am now. Setting aside GC concern, the only problem you might face is securing a loan with good rate, all lowest rate that you notice in internet banner or Bank flyer is not applicable to you, simple reason H1b Visa is considered as temporary Visa, once your loan application is taken by a banker, one of the question in loan app. pertain to Citizenship, if you're US citizen or GC holder then chances of getting loan with lower rate is higher(though many factors contribute to lower rate and loan approval), but if a person on H1B visa approach for a home loan, then Under writers perceive you as high risk borrower, some bank may deny loan if you claim as H1B visa holder, but some banks will approve loan but on higher rate.
In my case I was on EAD when my loan was approved, it was a hell lot of problem in convincing UW to approve loan, I approached my lawyer to get a letter stating that a person on EAD is one step closer to GC to get final approval, still I ended up taking 0.25 % more rate.

Here is my dilemma--
MY INFO---
Occupation -- Physician
EB2, INDIA, PD APR 2006, EAD renewed till sept 2010, H1 valid till feb 2010 (non-profit company), I-140 approved, I-485 filed July 2007
I have a very good job offer and I really want to get out of my present job. They expexct me to start work next year in about apr 2008-- The new job is not in my present state but I am freaked out about using AC 21 for following reasons:
-New company has no clue about H1 and they cannot file H1 any way because they are "for profit" and my h1 is presently from non profit and the QUOTA is now over. My occupation still remains same -(I am a physician ---no way to change occupation -- still have to do same job !)
-New company can only give me a generic letter for employment (EVL) ---
"To whomsoever ---etc..it may concern..and only briefly describing my title and job description"
--- My questions to respected IV members
1) should I invoke Ac 21 ??-- I am worried that the EVL may not meet USCIS needs as it may not be fully detailed
2) The other option I have is to take a leave of absence from my present company for one year and start working for the new company? IN this case what happens if I get RFE for EVL ? Hey guys,
I have a question to all of you...
AILA prepares the lawsuit and some (probably most) of the lawyers are supporting that.
For several days I keep hearing that WHEN you file (in July) is not important and I am wondering how that could be true...
I understand that the people who filed on July 2nd are beneficiaries of this but in my mind, everybody who files after falls under a different category because technically they would file after the revised bulletin was announced therefore have no argument. I understand that everybody else prepared (legal fees, medical exam and so on) and they are affected even if they didn't file but I am wondering how that can be justification enough after the dates (retrogression) were announced.
I am trying to understand why they say that it does not matter when you file. They need more people to back this up or is just so they can justify billing you for their work...
Is just scary, how many people play with our hopes and I need to understand if this is just to serve somebody's interests or it is what it is .
Please post your 2 cents ...

Thanks you all for the responses and help. We are searching for employers who can help me out in the situation. Most of them are thinking twice bcoz I am pregnant and have to take maternity leave within a 2- 3 weeks.

Thanks for all the inputs. I still have not received the letter ( probably because of winter strom - delay with traffic) .
Now if the Deniel is because of AC21 and 140 revoke , when we reply with MTR, should I sent copy of the AC21 letter we sent before or do we need to sent a fresh one ( employment verification letter ) ? The reason I ask this is when we originaly filed AC21 docs ( in Feb 2008) I was with Company2 . Now I am with company 3 ( just 2 months ). And good part of is company3 is well aware about the "same or similar " letter and is ready to issue the letter .

If you really look at who is paying less and misusing the H1-B and L1 to manipulate the job market, its the big offshore companies who bring the less experienced folks from India/China and other asian countries into US. These biggies pay way too less (52 to 57K) to these folks than what the conultants who work for local consulting companies make.
They apply for 1000's of H1B's and L1's showing the positions in US but 60% of the folks works back in their offshore centers in China or India with H1B/L1 stamped on their passport. Question is, if they applied for H1B / L1 based on an existing position in US and gets approved, why is that folks are still working in India or China center? Doesn't that mean they faked the position?
When we consolidated the vendors and excluded all the local consulting companies to include only two of the big offshore companies, we have seen their consultants brought onsite leaving them after few months at our group to join local consulting companies for better pay.
To me, they manipulate the job market displace americans much more than the local consulting companies.
I truely hope CIS look deep into these manipulations and frauds as well.
I think the unlimited number of L1's has been a 'bane' for the employment market here as they 'definitely' replace the American jobs.Again this might fit in to the company's strategy and I m no one to complain about it. I am sure most of the other consultants on H1B in this country do make decent enough ( > 75k ) to qualify for the wage bracket that is being applied as a statistic here. The fact is though is that the employers do advertise lower salaries for the positions there by creating requirement though they might be actually paying the employees more than the advertised salary.

Secondly, hire a good lawyer - it is well worth the expense and helps relieve your stress.
Thirdly, if possible, let someone else (such as your husband) drive the "discrimination" lawsuit if you think it is fit...helps give you some line of defense against the problem.
Regarding insurance, the employer must offer you COBRA. Also, not all insurance companies consider (or are allowed to consider) pregnancy as a pre-existing condition.
Keep the good focus in mind - let not this affect your baby. And at the same time, don't leave any option unexplored. There're plenty of suggestions in this thread. Ask your lawyer which ones you must explore...
