Dont go for gun even after you get green card. You can think about it after your citizenship. Green is just another type of visa which can be taken away. You right are fully protected only after you become a citizen. Even there also there is a catch in case of Naturalised of teh govt wants to go after you you cant dig you history and find a violation and base don that void te GC you got and teh citizenship.

chandrajp, many times it's not because of rules. It is common courtesy to go to a cafeteria if one is available. Smell of Indian food in general (it's a fact not criticism) may have a distracting effect in a work location so it should be eaten in a cafeteria (if available). Also, we need not emulate other people's lack of courtesy and do the same thing (like some people quoted Americans eating burgers in their cube). If we have the option, we should eat in the appropriate location.
In addition, with respect to discrimination, I do not condone it at all but we need to do a reality check for ourselves as well. I have never worked in India since I left the country 10 years ago but my friends working in India have told me how their managers have humiliated them by speaking in a regional language in meetings that they didn't know. So wherever there is a difference of culture, language etc., unfortunately human beings tend to behave the same i.e. discriminate against others who are different from them. This is the third time an Indian American has won the competition in a row.
BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.
All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.
Maybe your parents did not hug you enough when you were growing up, but that's not a justifiable reason to be jealous from these kids.
We are all born as genius, life de-genius us. Each one of us have the ability to be brilliant, it just depends how each one of us chose to spend our time. Folks who spend their time constructively are brilliant, because they have learned to ignore the negative. That's why these kids are brilliant and that's why they have the talent.

As long as you are in the business of making a rich guy richer, or as long as you are part of the system that makes more money for some hotshot powerful banker, we can all continue to live in this fool's paradise claiming that any new talent is always honored in this GREAT country.

This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?
Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.
Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.

One interesting point that came out of that recent hearing.
PD movement results in both 485 approvals + new 485 filings. CIS blames backlogs partly due to the policy that allows 485 filing whenever PDs are current. if PD movement results in 5 approvals, it also results in 10 new 485 filings and thus a backlog is built over which they have no control.
So in their opinion, PD movement should only control approvals & 485 filings should be controlled separately. If this happens, there would no backlogs and no one will ask them any questions or drag them to court for hearings!

I can only say - AC21 protects you, but cannot guarantee the ride will be smooth.

Having dealt with Americans in the past 8 years, I don't believe they planted evil designs in the current immigration systems just to get the best of us. The problem here is that people in this country have a very strong and almost unstoppable tendency to complicate things. Immigration system is one obvious example. PD date, quota, and ROW, millions of different forms etc. Its complexity is simply beyond you and me. Other examples abound. Legal system, taxation, state / federal relations, college admission, business dealing, etc. Once you reach teenage stage, there is no way you will ever live outside these sytems.
So why is this? First of all, Americans believe in fair and equal dealings between each others. Then natually they set up millions of rules / systems to even the play ground. Secondly, a complicate system is a lazy man's product. It's not a big deal if you can design a extremely complicated and all inclusive system. What's great is that you can make it simple and intuitive so even your grandma can use it, while at the same time it covers all objectives & purposes served by the complicated system.
My issue with this way of working is that the more complicated the system is, the more likely it will fail. Look at the space shuttle. Each of the one million parts was probably checked, double, and triple, and quandriply re-checked, but you put them together into the shuttle itself, you still got two space disasters in the past 20 years.
Another consequence of this social pattern is that systems most often get exploited by people armed with specialty knowledge. I guess everyone here paid the lawyers (or your sponsor paid). Same thing for the accountants. These specialists are taking advantage of the fact that ordinary people can not get a handle of the current situations and have to ask for help.
So why is this? First of all, Americans believe in fair and equal dealings between each others. Then natually they set up millions of rules / systems to even the play ground. I've been hearing a lot of banter about the L1 Vs H1-B the fact remains both these categories are badly abused, it doesnt matter who is the bigger evil. I would tend to agree that L1 has a worse abuse rate however.

When the H1-B was conceived it was supposed to pave its way really skilled engineers with excellent credentials and it is not the case anymore, 1)if you are going to tell me things like QA and Data Warehousing need mind boggling skills I think I can just have a good laugh at it. The local citizens are very much capable of executing on them. These jobs account for a huge majority of the software based jobs in the US, yes this is not the only category for H1-B jobs but software accounts for a big chunk.

It is your ignorance about software development cycle that makes you say good QA guys are not an asset for a good product and they are not smart as developers.
A tenth grader with enough common sense can do good software development. India produces lot of people with good common sense and analytical thinking. That is one of the reasons for India's software boom.
IMO if you don't have a patent in your name, you are not high skilled enough.
2. How many consulting companies do you know do charge their candidates for filing H1 ? I haven't come accross any. It is illegal to do that. If someone is doing that, ICE is after them.

Seems like a fitting reward for following the Laws, isn�t it?

We are always told, �Break the law, and you will be in trouble�. But, the recent �Immigration Reform Grand bargain� proposes to send a message that is precisely the opposite.
We are being told that no undocumented immigrant will get ahead of those in backlog.
