This bill if and when passed would let anyone in the US apply for an AOS.
Ahead of us(i doubt it).
This is just a rebranded version of something the dems were interested last time round.
You know my friend,
I sincerely doubt this measure passing, where anyone living in this country within the time span of 5 years can apply for permanent residency. However I seriously believe, there will be some final modifications on this bill.
Either way, we all IV members should be happy, something good is about to come for all EB members. I understand the economy is in a bad situation, however for Obama to create more jobs, high skilled immigration plays a vital role.

It would make more sense to compare and brainstorm if you can post the skillset you have in mind and the rate you wish for?
I agree that being on EAD or having a GC puts a person in a better situation compared to H1B but the bottom line is the skillset in context, demand for that skillset and expertise that one has in that skillset.

Hi Gurus,
I am in a unique situation and your valuable advice is highly appreciated. I worked for company A for 3 years and filed my 140 and 485(july 2007). I quit the company in may this year and joined another company. My 140 was approved on 06/16/2006. recently my previous employer revoked my I-140. I got a notice from USCIS that my I-140 and I-485 has been withdrawn. As per my new attorney since i meet all the conditions for job porting (180 days, 140 approved, and same job profile), no one else other than me can withdraw my I-485 application. my attorney filed an MTR today. Can i work while my MTR is pending. Is Withdrawal acknowledgement notice is same as denial notice ? please help

Freakonomics and IV participation by EB3IFreakonomics
The guys from Freakonomics did an experiment in a Chicago school. They said they will give $50 to all students who will get a B or higher in all their subjects. After some time they have found out that students who were getting a grade in the vicinity of B earlier have improved their grades to B level. But the students who were already well below B, actually went down in the grading; from D to E for example. You can google for the details.
In the GC saga, what we need is a B grade or above.
EB3 Mexico already has a C grade, hence he tries hard to improve himself to a B grade.
EB3I is in D grade. We more or less feel that trying hard is a waste of our time. If we try hard, we might get a C grade (means EB2I folks will get GCs :( :( ). The end result is that we go from D to E. That is what you are really seeing.
PS: despite the above generalization, I am planning to participate in the advocacy days in DC and I have already contributed to the efforts. Because human beings defy logic and what is natural to other life forms on earth.
If we don't stand up for ourselves, no one will do it for us. Mexico continued its advance in today's bulletin but there are just too many people in the queue to get this solved the right way.

Trust me my friend, I have seen it happen all the time, from large Telecom firm to Govt., its always there, most of the consultants just doesn't come to know about it, but the cut for the managers is there in some form, almost always. Why do each manager has a specific vendor through whom they want to hire most of the time? What else is the reason for the client to pay the consulting company $180/hr but they won't give 'valueablehurdle' anything more than $50-60/hr?
On a different note, now that NSG approved the waiver, most desi uncles, some of them are also owners of desi consulting companies will claim that they are the father of Nuclear deal. These bastards (sorry for my french) always oppose any GC fix and they tell their favorite congressman/senator (each has atleast one favorite politician for whom they do fund raisers) that gc backlog is not an important issue for the community. India Abroad, Times of India, rediff and other desi portals/newspapers will write 'Oliver North' style stories about these desi uncles knowing well that companies like GE etc put their weight behind the deal as it will create commerce to commerce over $20 billion/yr. But desi uncles/orgs will not stop claiming to be the father of nuclear deal. The fact is, most of these desi uncles made noise not because they wanted to do something for their country of birth, they are doing it because they think that if the nuclear deal passes, they can play middle man for US companies to sell the technology/material to Indian companies/govt. Most of the so called 'united voice of Indian-Americans on the Hill' organization's goal is to make big bucks by playing 'middle man' for companies wanting to sell technology to India. And as always, just as 'valuablehurdle''s client (paying $180/hr) Indian govt. will pay double the cost. These desi companies have squeezed blood of people waiting for gc, but now they think its time to move on to play big game with the big boys. These desi uncles/orgs are going nuclear.... time for Rediff and India Abroad to play Oliver North. Sometimes the line between capitalism and cycle of corruption is extremely blur. The problem is, these desi uncles/orgs claim to be representatives of entire Indian-American community, sometimes the entire immigrant community. They don't know more than 100 people, but they claim to be the leaders of all 2.5 million indian americans. For every one of us getting GC is a nightmare. Though USCIS follows a system, I feel it is not correctly followed. Also I noticed that people who have filed before the PERM process are really suffering. There are people who are in EB3, waiting for more than 9-10 years, keeping hope and anxiously waiting.
I feel that we should write to USCIS to clear all the pending GC�s (EB2, EB3) filed before PERM (March 31, 2005) need to be processed before they take up any cases filed in PERM.
This will certainly make the process rational.
Why don't we all campaign to ask for a time out on all immigration. Just stop all immigration until it is fixed. :D:D

Theoratically what you say is correct. Once the revised bulletin came out people are not supposed to file / send out mails in this matter. However, what the AILF is going to fight is the "revised bulletin". They are going to fight that uscis cannot publish a revised bulletin at such a short notice and if they (AILF) wins, this revised bulletin is nullified and July will become open to every one with LC, right??

There is another part in the I-131 rules document that you havent read,
"If you are in the United States and seek advance parole:
A. You may apply if you have an adjustment- of- status application pending and you seek to travel abroad for emergent personal or bona fide business reasons; "
which sorta makes any personal visit an eligible for AP visit.

Current crisis in UK is just one example, and i'm not surprised to see "slow bleed" approach.
It's up to individual situation and decision what to do next
Gandhi was never an immigrant and was in SA for solving a legal case on a temporary contract. He was always wanting to go back to India but because of the conditions of Indians, he was urged to stay back and help them, he actually went back in between and again came back to SA for a more organized effort.
The situation now is different. The Durbin Grassely bill lobbyists are basically doing what has been happening in UK where local population do not want Asian immigrants taking high paying challenging jobs in their own soil. They don't seem to care if these jobs go away because the effect will be long term and as such it is a known fact that in these days, we seldom see the immigrant community having a good cooperation, every immigrant feels that one less immigrant, it is good for him.
This has been happening in every country where highly skilled migrants take job positions in countries like Aus, NZ, UK, Germany etc..
The US system is harder to crack for anti immigrants than these countries. So they follow this slow bleed approach. On the long run their objectives will be met though it would force out high skilled jobs abroad.
One good thing is that developing nations must capitulate on this and make their labor laws good and also copyright laws and patent laws so that innovation and products are developed in developing nations and so called developed nations will bleed technology and innovation.

Sept dates may advance and some lucky ones are sure to benefit --but for their attempt to use the remainder of visa #s in fiscal year09. Now since most cases are pre-adjudicated hopefully they won't pick up randomly
If we do not see many approvals in August I am sure Sept will open floodgates similar to what we say in July 2008 when so many 2006 apps got GC.

Ron Gotcher said something similar... they may be trying not take any more
applications from 2000-2009 until they finish the backlog. That may be one of the
reasons why they may have retrogressed to 2000. Just my 2 cents.
