If your labor is pending 180 days you can apply for a 1 year visa extension. If you get your I-140 approved under premium processing after your labor approval and before your visa expires you can apply for a 3 year visa extension. You can apply for any other new visa L, J, F etc., and continue to stay inside the country but not H visa otherwise you have to be outside the country for 1 year.

I am in 6th year of H1 and my company is working to file Labor. If I include time spent outside US, I have time till April 25th to file it . I got a call from paralegal on my case, saying that process has changed since Jan 1 and we need to get prevailing wage from Washington which might take like 5 months? Is this true? Is it possible to submit job order based on my present salary hoping that prevailing wage will come lower than this number? Is this workable? Please help to advice. If nothing works, I need to start planning to leave US.

EB2= 45,573 + 6,738 ( at NVC) + Huge backlog waiting in line.
EB3= 114,442 + 102,395 ( at NVC) + unknown backlog waiting in line.
*NVC stands for National Visa Center.
** Does not include service centers.
* Spillover to EB3 may not happen for several years due to a large number of EB2's waiting to submit their 485 applications.
* Even if spillover occurs, majority of them will go to EB3 Philippines (please See the NVC backlog).
* From the above, assuming no spillover to EB3-I, it would take (56,640 + 20,873)/2600=30 years.
* With spillover (lets say after 5++ years due to the pending EB2�s), it may take another 5 to 7 years to clear the EB3 backlog.

yaja, are you sure that she would not need an EAD? what would be her status? AOS case pending? and what would she need to show the officials as documentation for her status within the country? AOS receipt?
You are right about the AP part. If she does not intend to travel, then she would not need an AP; however it is always prudent to keep AP handy, just in case if she needs to travel for emergency reasons. AP takes around 2 to 3 months on an average for approval.

My gut feeling would be in agreeing with what your attorney says regarding the difficulty with the same job description but differing EB category.
However, I don't think the attorney would have filled for the EB2 knowing that it would not be accepted, especially if your company is paying for the process.
I guess you'll only really know if the tactic works when your EB2 LC is resolved.
I'm far from an attorney, but your general position seems similar to what I've been considering for a while (that's why I know a little bit about this). Sorry - can't be much more help other than that - its just my guessing, really. Maybe others on this board have applied the same theory with success.

If you are one of those Indians who has an innate desire to look at everything with a shade of pink glasses you should reconsider living here. Airlines don�t fly one way from India to US. You can always take the flight back home. 16-hour workdays, a fantastic work life balance, and all basic amenities await you in the land of kamadhenu (the sacred mythological cow that gave the Hindu Gods everything they needed for a happy life)

Stock options work like this
If a company gives you 100 shares at 10$ each that means you have the option to buy them by the expiry date at 10$ each.
So if within the expiry date they reach to 15$ you can buy them at 10$ and sell at 15$ getting a net profit of 5$ per share ( 500$ )
In your case the share price is below what you will have to buy the shares at . So no use. You will be losing money in case you decide to sell them.
Although if you think the share price is going to rise in the future you can buy them and hold them long term until the share price rises above 30 and you make some good money .

Its very simple, they are anti-immigrant channels, dont you know lou dobbs, o'rielly anti-immigrant shows have more ratings, so there is no way they want their viewer change their mind on immigration system. they are surviving on anti-immigrant programs.

Hello,
I want to make it clear that I have read the manual that came with my D70... But I seem to be having an issue that I'm not exactly sure of the cause whereas I haven't altered any of the settings since I purchased/recieved it... unless I did something without realizing it.
One of the very first pic's I took with my D70 was of the moon. As you can see from my attached (cropped) image, "in my honest opinion anyway", I think they came out awesome rather decent for being taken "handheld" via a Sigma 300 mm kit lens...
Anyway... I took maybe a half dozen Moon'shots over the following couple of nights and everyone of them was "in focus" and relatively clear as the attached image... I proceeded to take other shots of various subjects over the following couple of weeks until one night the sky was crystal clear and there was a 3/4 Moon. I attempted to take the picture the exact way I took them the first couple of nights, with everything at its "default" settings (unless as I said I changed something without knowing)... What I found has left me bewildered. I can aim at & focus the Moon in crystal clear within the center brackets and then proceed to press the shutter release... only now "every single shot" will in the end, be nothing more than a gaint fuzzy snowball. I've even attempted taking a shot via the "Timer Release" feature whilest the D70 is mounted to a Tripod on solid ground, and its always the same thing. The image in the viewfinder is as "crystal clear" as I could ever hope for, yet when the picture is actually taken its a giant fuzzy snowball.
As I stated above, I've gone through the manual while looking at the camera in hand but I in no way remember ever changing anything where as this is my very first "fully adjustable" camera of anykind, digital or otherwise...
Any help would be truely appreciated...
