Comtting a crime and trying to blame others for that....
is that what you are supporting?
Snathan
I asked for advice, if people can give I am more than happy to accept it. I don't expect to beat me for the sin that I have done.
I am not blaming any one here. I don't have right to blame as well others.

I know this is not releated with Immigration. If you dont want to answer, that is fine. Just ignore this.
I have money crunch in US. I have accumulated huge debt in my CC. In past I have sent some money to India, but now when I ask my parents to send it here, they tell it is not possible without losing 30%. This is what they heard from my bank. Any Idea on how to get money from India from my own account to which I have sent from here.
I am in the other way round,Last year i bought a house in india and i keep sending money to india as soon as i get my salary deposited everymonth. Lot of my friends are in the same boat,we send all our savings to india. I send not less than $3 k /month to india and can try to help you.
Let me know how much you are planning to get here ,so that i can think of it. We can work on a mutual benefit way, if you are interested.
I live in Louisville,KY.

I read the views .. that talking to lawmakers makes the difference.
I'm a little surprised here.
The long wait for the GC is an age old issue. I know folks who came here in the 80's and 90's and went through the same issues. There were brief periods when the process did speed up .. but by and large it has been the way it is.
Lawmakers can say .. 'oh I did not know it took 7 years to get the green card." But I find that tough to believe that no one knew this until we went and said this to them? (h1 quotas get extinguished in a day .. and everyone knows this ..
The situation is still the same. CIR also puts out there .. the need for Immigration reforms. So pretty much everybody out there knows what the issue is. Now what can we do to make them move on it quickly.
I agree that getting together educated folks is difficult .. since they have no Union (like workers) and are not as close as blue collared folks. And that's the main reason why an illegal immigrant rally can get a million people on the street .. whereas a legal immigrant one gets in a 1000 people or 2000.
To summarize:
1. I think people in concern know that the immigration process is inefficient
2. Unless there is sufficient sustained pressure, nothing can change.
I would say this .. the question is this ... how can we get a huge rally going in key cities in successive weeks, so we get noticed and we can send across a stronger message?

My request for help on the following post http://immigrationvoice.org/forum/showthread.php?t=12255 is not going well, I am still waiting to hear from analytical minds.
Anyways, we are in process of creating an eye opener fact sheet that we will be distributed with the promotional fliers. The objective of the fact sheet is create a sense of urgency and draw people's interest to DC rally.
I am looking for ideas as to what to put in the fact sheet, while I am still waiting to hear on my other post.
Please contribute you thoughts. We need to get this completed in couple of days.

will be glad to email, but so that all of us are consistent in our request, can you highlight what we are specifically asking for in lame duck session:
Is it SKIL bill, increase in visa numbers, or something else?
While we dont want to sound repetitive, it will help if we are all asking for the same two or three things.
do you think it will be helpful to have a generic draft of the email to send, which can be modified or not by each person sending it?
You can talk about how us competiveness is being affcteted.
quote February 2006 Economic Report of the President on IV homepage
basicall the first paragraph of IV site has info--
"Skilled workers are a small minority of U.S. legal immigrants. Of the 940,000 legal immigrants in 2004, only 16% were skilled employment-based immigrants. About 40% of these skilled immigrants had advanced degrees, or 5 or more years of experience after a baccalaureate degree. The impact of these workers’ contributions to American competitiveness belies their small number. They add to the process of scientific discovery, technology development, and innovation, which in turn leads to greater productivity growth. Greater productivity growth improves the standard of living for the U.S. population as a whole. Skilled immigrants not only contribute to the innovation process themselves, they also help train our own future innovators, thus ensuring the competitiveness of future generations"
You can talk abouty skil bill how it will help us innovation and also talk about retrogression and how 485 filing even if visa numbers are not available and recapture of unused green cards during the past years will help improve the quality of life for high skilled immigrants (engineers, doctors, professors, scientists, teachers etc). some information is here
http://immigrationvoice.org/index.php?option=com_content&task=view&id=71&Itemid=36 do not forget to mention IV name for more information.
nycgal369 if you could help draft a format on this thread and everyone could use it (with modification). Your help will be very valuable for everyone.

What we need this time around is a basic introductory article describing the Green Card journey to the general public overseas.
What do you mean by GC Journey? Do you mean the various USCIS stages (labor, I-140, I-485, ...) in the GC process? If yes, I can do that. However, I am not sure when it will get done. What is your deadline?

Dude, i think you are thinking too much of it. USCIS is NOT an organization that goes by process.
No intention of harm or personal flame... i just wanted to show how a statement of exactly opposite nature can also sound equally plausible.

Hello Guys,
I need your advice here. Six month ago i joined one of the many blood suckers -Desi cosulting company in new jersey. As you all know, they ask me to sign their contract in which its mention that if i leave their company before 1 year then i need to pay them 15k. Thy also charge me 3k for my H1-B which i am still paying everymonth from my paycheck and we have 70/30. In just six months i am so much fed up with them. These people are so rude...always show their arrogance over phone. I have no libarity to find job by myself. They always looking for higher pay rate sp that their big money tummy get filled up.and i also feel that they didnt told me the right pay rate for the project i am working on right now.
I really want to leave them, Even before 12 months. Is there any importance of that contract letter i signed with them?. Can they Sue me? What are my options? Please suggest me.....i am in stress.
Thnx
Leave them. they can't do anything. just make sure you get your last months salary into your account. point to note that once you see you salary into your account its take around 2-3 more days to make the final transaction into your account.
GTSS,Inc bugger did this some us when we left it. these a%*&^ss holes live on our salaries and shameless dont pay us when we leave them.

GO home and stand in front of a mirror and ask yourself if your 3 year degree and a masters bought for 4k will get you a greencard in eb2.
That is what exactly I am trying to find. Not in front of a mirror. But searching in forums where I might get correct answer.
It is not about 4K Masters or 14K Masters.
I am looking for information on what credentials does USCIS look for when evaluating Masters degree. Is it the Accredition of the University, reputation of the University, Length of the degree.
I just need a well thought-out answer.
I can get Masters from well reputed south african university for well below 4K. OR there are diploma mills who sells masters for 8K which are of no worth at all.
Why r u guys looking at the cost of the degree. Give a thought about why USCIS might deny I-140 when one applies with an US Masters Degree.
If USCIS does not accept Masters Degree from Aspen which is (Nationally Accredited by DETC). then USCIS might not accept Masters Degree from any university which are acrredited by DETC..
Let me know if I am thinking anything wrong..

So that we get enough attention... I wrote one awhile back, still no luck.
Instead of writing individual letters, we should approach through appropriate channels like some lawyers, AILA etc. Not sure though.

Folks,
I bought whole life insurance for my wife year ago for $300k from PRUDENTIAL, monthly premium is $116/month but $72 went to admin. and tran. charges. Although I paid $1276 last year, my balance was $476 after 25.2 % return on funds. whole life has surrender charges apart from hefty financial charges ,so you can not withdraw when you want.
I took $1500 loss and canceled my whole life insurance policy since I do not want to waste 70% of my premium as a financial charges.you are feeding for a company and agent s getting heavy commission on this.
Buy term life insurance and invest in Vanguard Index funds for investment purpose.

In fall 2003, an applicant filed a green card application, which remained pending due to FBI name checks until spring 2007. During the course of the adjudication, the applicant was fingerprinted and applied for interim benefits several times.
Although the applicant applied for most of the interim benefits in a timely manner, the filing of the last EAD was not timely, and the applicant had to end his employment. In correspondence to the Ombudsman in the winter of 2007, the applicant related that he is a cancer patient who no longer has income necessary to pay for treatments. (page 40)
A green card application filed in late spring 2003 with a service center remains pending. The applicant filed his fourth EAD in the fall of 2006. In January 2007, the applicant needed the EAD to continue employment, but had not yet received it more than 90 days after filing. As advised by USCIS, the applicant visited the USCIS field office to obtain an interim EAD. At the field office, USCIS told the applicant it no longer issues interim EADs. USCIS gave the applicant a form to request an interim EAD, which the applicant filed with the service center but received no response.28 The applicant contacted the Ombudsman in February 2007. The applicants green card application remains pending, while the interim EAD was approved late. (page 17)

The Schedule A Workers category has become oversubscribed for November and a cut-off date established to hold number use within the 50,000 numerical limit. It is expected that demand will bring allocations up to the program limit during November. Once the limit is reached no further allocations will be possible, and the category listing will be removed from future cut-off date tables.
A PD for Schedule A category is for those people filing under EB2 with exceptional skills in arts and sciences . We had a post recently. Nurses and PT's do not have PD's as they do not have to file Labor Cert in the first place.

I wasn't moral policing, I was just laying out the legal stand that anybody can have under these circumstances. I am sure that the so called "Desi shop owner" is not so dumb to so flagrantly violate the law when his employee is going by the book, unless the employee is seriously gullible.
I agree it is illegal for employer to charge for H1B, and of course the employer is in violation of the law, but one needs to ascertain that the employee is not a willful accessory to that violation.
sc3, your argument is totally wrong. The employer has violated the H1B rules and most of the employees who come from India for the first time may not know that its illegal to foot the charge for H1b.
Its like telling a woman not to complain to the authorities about the abusive husband, if the husband beats her up, stating that she know it was wrong and so she is party to the wrong doing. Common man!!!
If you are stuck and are exploited, there are protections in Law that would not come after you. There are immunities that apply.
H1B guy, the best course of action for you, in my opinion:
1) consult an attorney.
2) gather as much evidence as possible related to the charging for H1B.
3) find another project.
4) Try to record the conversation between you and your employer. Most state allow to one party consent except California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania and Washington.
You don't have to be afraid of a company that is doing business unethically.
Good Luck!!!
