Guys,
Let us differentiate ourselves. Legal immigrants include people who come here on family based PR petitions. We are Highly skilled legal Immigrants.
IMHO, WE SHOUD USE "WE ARE HIGHLY SKILLED LEGAL IMMIGRANTS" INSTEAD OF "LEGAL IMMIGRANTS". Going by what is happening in the hill and elsewhere, this distinction will work favorably for us.
PAPPU, others, comment. Let us all be consistent.
I used the subject line: US immigration system: problems faced by legal immigrants
thanks for taking the lead on this issue.

Thanks Belmont for support, as explained in other thread for some guy who is beating me or people like us, it's a mistake/accident. It can happen with ones mistake or without mistake (Car accident).. Some one get caught and some one don't... as example I knew many people who steal/use office supplies in the company they work...
Thank you guys for your replies..........
Hope god helps!!!
Cheers :)
Dont try to justify what you have done. Dont you be ashamed to talk like this.
On top of that you are calling GOD for your help. Why dont you try to bribe him?
Steeling something and car accident are same. Give me a break...
No wonder why you are through this.

WithoutGCAmigo, no panic. there are processing dates which you should be worried about after you file EAD / AP etc.
To file it goes per visa bulletin. Hope you are upto date with that.
thats the talk of the town, sorry COUNTRY now
IV memeber experts - should be on the way to throw more light / clarify

Time to wake up and push this bill. IV should motivate members to write to law makers. Also have a funding drive.

Not necessary US wants the best of best to get the green card. They see variety of immigrants is more important to US and that is why they setup country limit and setup DV lottery. If they simply want the best of best, they can cancel the DV and even reduce family based and all move to the employment based.
If you really want to talk about a system in jutice, then we are looking at one applicant for each country at a time. I guess OP will not like to see this happen either.

EVERYONE picks their nose and EVERYONE farts in private and public.
the above is a fact.
Most of the time it is discreet but there are times you get caught.
Guys if someone tells you stuff like why do "male desis..." it shows that they do not have a high opinion of desis.
So even if you visit the salon daily it will not be enough to change their perceptions.

Anybody wont be eligible. Canada has been fine tuning the immigration since 2002.
Now only people who have studied or worked in Canada on work permit are eligible.
family based is greatly restricted unlike US where around 80 is non-skill based.
That may be the unofficial version. Officially you can apply even you haven't worked or studied in Canada if you qualify as a skilled worker with a year of experience. You get extra points for having a job offer from a Canadian employer but not having one does not disqualify you automatically. I'm not talking about getting the GC. I'm just talking about the application process. Some kind of processing is needed even to reject an application and I do not think USCIS is capable of handling the increased traffic that switching to a point based system would result in.

How does a lawyer know if u r stuck in namecheck? Unless you go to infopass you may not know.
In reality, the app was just taken up for processing - the IO figured that FP has not yet been done and sent notice and during the course of processing the app, decided to send it for interview.
Perhaps u r right. Lawyer might have just made up that story to get him off his back. The guy was pretty annoyed at not getting FP notice. He went for infopass twice and all they did was sent a FP request to CIS (told him they were doing that) but nothing happened.

Why the bloody hell are you guys judging him for what he has done? He only asked for some advise regarding immigration implications of his situation.
I do not think any of you who is beating him down like this has any right in doing so. I bet that each and every one of you have done more mistakes than Mr.Sahaayam did. You just were never caught. You must have done more filthy things than 'shop lifting'. I'm sure you have all lusted after women, watched porn, frequented strip clubs and drank a lot of filth. Some of you might have slept with more than one woman.
Don't you think these are more filthy than shoplifting? Guys come on! I would not have any problem if one of you who has never committed any mistakes in life would point out other people's mistakes. But none of you are good enough.
If anyone wants to reply to my post, I would like the first person to do so to be the one who has never committed any mistakes in life so far! Others please get lost.

You are correct. The rules must have changed recently. I wonder what made them make that change, Now children of US citizens (who were once Indian citizens) have an advantage over children who has both parents as Indian citizens. Weird.. isn't it?
I don't think that the rules are unfair. If both parents are Indian citizens, then the child is eligible for primary citizenship of India. Hence how can he be allowed to take OCI when he infact can get primary citizenship? Also the rules are created with rules for all countries in mind not just USA and also they are intended to protect those who lived in India, paid taxes in India and these rules are to protect interests of children born in India.
I live in US with my wife, we dont have any kids and yes I am in race for GC. But I also know a few couples who applied for US passport for their kids, went back to India, got their kids educated at Indian Citizen's fee schedule in general quota and then sent their kids to US back with citizenship of US.
So..... didnt this put Indian kids born in India at disadvantage?

Well, MS + 11 month (but not 12) will do then, cause zone IV is has SVP "7.0 to < 8.0"
I (DOL rather) take it back. SVP "Levels" are not fractional so (7.0 to < 8.0) actually means 7 only (http://online.onetcenter.org/help/online/svp):
7. Over 2 years up to and including 4 years
8. Over 4 years up to and including 10 years
So there is nothing between 7 and 8, and since 8 is not included into the interval it means 4 years max for zone IV. Period!
So, for zone IV employer can't require more than BS +2 or MS with no experience for the requirements to be considered "normal". Nice!
Check out this passage from the Job zone IV desctription though:
"For example, an accountant must complete four years of college and work for several years in accounting to be considered qualified."
So "several years" can't be more than 2!!!!
